Pocket Trash

Pocket Trash is a personal, independently operated, non-commercial hobby project based in Ontario, Canada. These Terms of Service ("Terms") state the rules for accessing the Pocket Trash website and related services (the "Service"). In these Terms, "Pocket Trash," "we," "us," and "our" mean the individual operator acting through the Pocket Trash project.

Read these Terms and our Privacy Policy before using the Service. By creating an account, uploading content, or continuing to use the Service after these Terms are presented to you, you agree to follow them. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 to use the Service. If the law where you live requires a parent or guardian to approve your use, your parent or guardian must review and accept these Terms.

You may use the Service only where applicable law permits it. You must have authority to accept these Terms for an organization if you use the Service on its behalf.

2. Your account

You must provide accurate account information and keep it current. You are responsible for activity under your account and for protecting your credentials.

Tell us at privacy@pocket-trash.app if you suspect unauthorized access. You may not share an account in a way that bypasses access controls or impersonate another person.

3. The Service

Pocket Trash lets users organize collections, contribute product or catalog information, upload images, and share resources and related files. Features may change as we maintain and develop the Service.

We do not guarantee that a specific feature or piece of content will remain available. We will provide notice when applicable law or a separate agreement requires it.

4. Your content

"Your Content" means collection data, collection-item data, catalog contributions, images, resource metadata, resource files, comments, and other material that you submit through the Service.

You keep ownership of Your Content. You represent that:

  • you own Your Content or have the rights and permissions needed to submit and use it through the Service;
  • Your Content and our permitted use of it do not violate law or another person's rights; and
  • information you provide about another person comes with any consent or authority that law requires.

Licence for private content

You grant Pocket Trash a limited, non-exclusive, worldwide licence to host, store, back up, reproduce, format, process, and deliver private content as needed to provide the Service to you.

Licence for public content

While you mark content public, you also grant Pocket Trash a limited, non-exclusive, worldwide licence to display and distribute that content through the Service. This licence lets other users view and, where the Service permits, download the content.

These licences do not transfer ownership to Pocket Trash.

The licence for your collections, collection items, resources, files, and images ends when complete erasure removes that content from active systems. Provider-managed copies may remain for the limited periods described in the Privacy Policy, and Pocket Trash cannot recall copies that another person downloaded while the content was public.

If you contribute product, image, finish, material, mechanism, or taxonomy information to the shared catalog, you also grant Pocket Trash an ongoing, non-exclusive, worldwide licence to maintain, correct, reproduce, display, and distribute that contribution as part of the shared catalog. Pocket Trash removes your account attribution during account erasure. This licence does not permit unrelated advertising or transfer ownership of your contribution.

5. Visibility and deletion

You may use the Service's controls to mark supported collections, collection items, resources, files, or images private. Private status stops normal public display through the Service.

You may delete supported content or request complete account erasure from your account settings. An authorized administrator may start the same workflow after verifying a request. Once confirmed, an erasure request cannot be cancelled and the account becomes read-only except for its status page.

Complete erasure deletes account-owned collections, resources, files, images, account records, and other linked active-system data. Pocket Trash preserves approved shared catalog and taxonomy contributions after removing account attribution. Provider-managed backup, cache, and log copies expire within the bounds in the Privacy Policy. Pocket Trash keeps a minimal erasure receipt until those bounds expire plus 30 days.

Changing visibility or deleting content cannot remove copies that another person made while the content was public.

6. Acceptable use

You may not use the Service to:

  • break the law or violate another person's intellectual-property, privacy, publicity, or other rights;
  • upload content that you do not have permission to use;
  • harass, threaten, exploit, or impersonate another person;
  • distribute malware, harmful code, spam, or deceptive material;
  • interfere with the Service, probe it for vulnerabilities without authorization, or bypass access and security controls;
  • scrape or collect data from the Service except through a method that Pocket Trash permits;
  • upload sexual content involving minors or other unlawful or exploitative material; or
  • use another person's personal information without a lawful basis.

7. Reports, Maker and Rights Requests, and moderation

Send privacy complaints and requests to privacy@pocket-trash.app. Send content reports, correction or removal requests, and intellectual-property concerns to rights@pocket-trash.app. Include enough information for us to identify the content, understand the concern, and contact you.

Maker and Rights Requests

A maker or rights holder who asks us to remove a product record or image should provide:

  • their name and contact information;
  • the maker or rights holder they represent;
  • the product, image, or URL at issue; and
  • the right or interest involved and the requested action.

Pocket Trash may review, restrict, make private, or remove content that violates these Terms, creates risk, or infringes another person's rights. We may suspend or terminate accounts involved in serious or repeated violations. We will consider the circumstances and any rights that applicable law gives you.

8. Catalog data and third-party rights

The Service may contain product names, images, descriptions, specifications, files, trademarks, and other material supplied by users, makers, or other third parties.

Pocket Trash does not claim ownership of third-party product names, trademarks, photographs, descriptions, specifications, or other materials. Those materials remain the property of their respective owners and appear for product identification and reference.

Pocket Trash does not claim affiliation with a maker merely because the Service refers to that maker or its products. Where available, catalog records may link to the maker's main website for reference.

Users remain responsible for material they contribute. The presence of third-party material does not mean that its owner sponsors, endorses, or is affiliated with Pocket Trash. A maker or rights holder may request review, correction, or removal at rights@pocket-trash.app.

9. Pocket Trash property

Pocket Trash and its licensors own the Service's software, design, branding, and other material that we provide, excluding Your Content and third-party material.

We give you a limited, revocable, non-transferable right to use the Service for its intended purpose while you comply with these Terms. You may not copy, sell, sublicense, reverse engineer, or exploit the Service except where law permits it or we give written permission.

10. Third-party services and links

The Service relies on third-party providers and may link to third-party sites. Their terms and privacy practices govern your relationship with them. Pocket Trash does not control their independent services or content.

11. Suspension and termination

You may stop using the Service and request account erasure at any time.

Pocket Trash may restrict, suspend, or terminate access if you violate these Terms, create security or legal risk, or if law requires action. We may act without advance notice when delay would increase harm. We will provide notice when circumstances and law permit it.

Sections that need to remain effective after termination will survive, including provisions about ownership, permitted retention, disclaimers, liability, disputes, and enforcement.

12. Fees

The Service is currently free. Pocket Trash will present additional terms before offering any paid feature.

13. Service availability and disclaimers

To the extent permitted by law, Pocket Trash provides the Service and user or third-party content on an "as is" and "as available" basis. We do not promise uninterrupted access, error-free operation, or the accuracy of user, maker, or catalog content.

Applicable law may give you warranties or consumer rights that these Terms cannot exclude. These Terms do not limit those rights.

14. Limits on liability

To the extent permitted by law, Pocket Trash and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Service.

Nothing in these Terms excludes or limits liability where applicable law does not permit that exclusion or limit.

15. Responsibility for claims

You are responsible for claims caused by Your Content, your unlawful use of the Service, or your material breach of these Terms, to the extent applicable law permits.

16. Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules.

Courts located in Ontario will have jurisdiction, subject to any mandatory right to bring a claim elsewhere. Nothing in these Terms removes rights or remedies that applicable consumer law does not allow you to waive.

17. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or our operations. We will post the updated Terms with a new effective date. When reasonably possible and when applicable law requires it, we will provide additional notice in the Service or by email before a material change takes effect.

For a material change, we will provide any additional notice or renewed acceptance that applicable law requires.

18. General terms

If a court finds part of these Terms unenforceable, the remaining terms will continue to apply. Our failure to enforce a term does not waive it.

You may not assign your rights under these Terms without our written permission. Pocket Trash may assign these Terms as part of a merger, reorganization, financing, or sale, subject to applicable law.

These Terms, the Privacy Policy, and any additional terms presented for a specific feature form the agreement between you and Pocket Trash about the Service.
